MONTCLAIR, NEW JERSEY November 20, 2007
The Council of the Township of Montclair, in the County of Essex, met in the Conference Room in the Municipal Building, 205 Claremont Avenue, for a Conference Meeting at 6:10 P.M.
Present: Deputy Mayor Michaelson and Councilors Freier, Lang, Schlager and Tobin
Absent: Mayor Remsen and Councilor Mattox
STATEMENT OF SUNSHINE NOTICE
INCIDENT COMMAND SYSTEM:
GUEST: Chief John Alderton, County of Morris, Emergency Management Fire Training Coordinator, explained that this training program was a direct result of 9/11. Its intent is to manage all sources at any given time for any emergency event.
The ICS was formulated under Executive Order 50 which established specific criteria for the system. Any municipality which meets these criteria may also be eligible for both Federal and State emergency management grants.
Chief Alderton explained the Urban Area Security Initiative (UASI) as it relates to a municipality’s emergency needs. A key component of this initiative is “shared services.”

Types of Incidents and Incident Management Team:
- An IMT may be used to respond to an incident.
IMTs include Command and General Staff members.
- IMT TYPES CORRESPOND TO INCIDENT TYPE AND INCLUDE:
- TYPE 5: Local Village, Town, Township, or Lowest Level of Government
- TYPE 4: City, County, or Fire District Level
- TYPE 3: State or Metropolitan Area Level
- TYPE 2: National and State Level
- TYPE 1: National and State Level (Type 1 Incident)
- Team members must have training and experience to fulfill IMT positions.
A critical part of any response effort is the Public Information Officer. This may be the Township Administrator, Fire or Police Chiefs and/or Council members.

At 7:06 P.M., on motion made by Mayor Remsen and duly seconded, the following resolution was adopted by unanimous vote:
WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975, permits the exclusion of the public from a meeting in certain circumstances; and
WHEREAS, this public body is of the opinion that such circumstances presently exist,
NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, as follows:
1. The public shall be excluded from discussion of and action upon the hereinafter specified subject matters.
2. The general nature of the subject matters to be discussed are as follows: Contracts, Personnel and Litigation Update.
3. We do not anticipate that the matters discussed will be made public.
4. This resolution shall take effect immediately.

At 7:47 P.M., on motion made by Mayor Remsen and duly seconded, the Executive Session was adjourned by unanimous vote.

NEW BUSINESS
Mayor Remsen introduced the following ordinance and made a motion which was duly seconded, that it pass first reading and be further considered for final passage at a regular meeting of the Township Council to be held on December 18, 2007.
“ORDINANCE AMENDING SECTION 341-9 OF THE TOWNSHIP CODE TO ESTABLISH NEW RATES FOR WATER PURCHASED FROM THE TOWNSHIP EFFECTIVE JANUARY 1, 2008.” (07-53).
The motion was adopted by unanimous vote.

Mayor Remsen introduced the following ordinance and made a motion which was duly seconded, that it pass first reading and be further considered for final passage at a regular meeting of the Township Council to be held on December 18, 2007.
“AN ORDINANCE AMENDING CHAPTER 269-22 OF THE TOWNSHIP CODE (THE SEWER UTILITY ORDINANCE) TO ESTABLISH NEW RATES FOR SEWER CAPACITY CHARGES EFFECTIVE JANUARY 1, 2008.” (07-54).
The motion was adopted by unanimous vote.

Councilor Tobin questioned the recent proposed increases in water rates in contrast to Montclair’s
past stable rates. Township Manager Joseph Hartnett explained that the “old” rates were artificial and did not reflect the true cost of providing water to Township residents, thus creating a financial deficit in the Water Utility.
The Council directed the Township Manager to prepare a public information notice on this subject.

On motion made by Mayor Remsen and duly seconded, the following resolution was adopted by unanimous vote:
WHEREAS, the Township of Montclair and the County of Essex wish to continue various cooperative relationships in order to achieve cost efficiencies to the mutual benefit of the Township and the County; now therefore
BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, that the Council hereby approves the execution of an agreement between the Township and Essex County whereby the Township will remove leaves from County roads in exchange for the County providing the Township with up to $15,000.00 of rock salt, and the Township Manager is hereby authorized to make all necessary arrangements to effectuate this agreement.

On motion made by Mayor Remsen and duly seconded, the following resolution was adopted by unanimous vote:
BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, that TOM MOLOUGHNEY and THOMAS HAYNES be and they hereby are REAPPOINTED to serve as members of the Montclair Economic Development Corporation commencing immediately and terminating December 31, 2010.
BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, that ROBERT W. EBERHARDT, JR., be and he hereby is APPOINTED to serve as a member of the Montclair Economic Development Corporation commencing immediately and terminating December 31, 2010.
BE IT FURTHER RESOLVED by the Council of the Township of Montclair, in the County of Essex, that STACY ROBIN be and she hereby is APPOINTED to serve as a member of the Montclair Economic Development Corporation commencing immediately and terminating December 31, 2008.
