MONTCLAIR, NEW JERSEY April 15, 2008
The Council of the Township of Montclair, in the County of Essex, met in the Conference Room in the Municipal Building, 205 Claremont Avenue, for a Conference Meeting at 7:06 P.M.
Present: Mayor Remsen, Deputy Mayor Michaelson and Councilors Mattox, Schlager and Tobin.
Absent: Councilors Freier and Lang
STATEMENT OF SUNSHINE NOTICE
ESSEX MAYORS AND MANAGERS GROUP:
Mayor Remsen updated the Council on this group whose focus is to work together to address mutual municipal problems and state mandates.

SUPPLEMENTAL DEBT STATEMENT
Municipal Clerk Linda Wanat stated: “Mayor and Council, I wish to report that the Director of Finance has this day filed with me a Supplemental Debt Statement duly verified by his oath showing the percentage the net debt of the Township bears to the average assessed valuation for the years 2005, 2006 and 2007 to be 1.151%.

Mayor Remsen introduced the following ordinance and made a motion which was duly seconded, that it pass first reading and be further considered for final passage at a regular meeting of the Township Council to be held on May 6, 2008.
“BOND ORDINANCE APPROPRIATING $5,346,848 FOR VARIOUS IMPROVEMENTS TO SCHOOL BUILDINGS AND GROUNDS IN THE TOWNSHIP OF MONTCLAIR, IN THE COUNTY OF ESSEX, NEWJERSEY AND AUTHORIZING THE ISSUANCE OF $5,346,848 BONDS OR NOTES OF THE TOWNSHIP FOR FINANCING THE COST THEREOF.” (08-14).
The motion was adopted by unanimous vote.

On motion made by Mayor Remsen and duly seconded, the following resolution was adopted by unanimous vote:
BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, that the Mayor and Township Clerk be and they are hereby authorized to execute and attest an Easement Agreement with New Jersey Transit Corporation related to the Bellevue Avenue Train Station in a form substantially similar to the Agreement attached hereto, subject to any revisions approved by the Township Manager and the Township Attorney.

On motion made by Mayor Remsen and duly seconded, the following resolution was adopted by unanimous vote:
BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, that the Mayor and Township Clerk be and they are hereby authorized to execute and attest a Modification Agreement to the 1983 Lease between the Township and New Jersey Transit Corporation relating to certain train station parcels, in a form substantially similar to the agreement attached hereto and made a part hereof, subject to any revisions approved by the Township Manager and the Township Attorney.

On motion made by Deputy Mayor Michaelson and duly seconded, the following resolution was adopted by unanimous vote:
WHEREAS, the Township of Montclair owns various motor vehicles which are no longer in service, and the Township wishes to dispose of such vehicles; and

WHEREAS, N.J.S.A. 40A:11-36, provides that the governing body of a municipality may authorize the sale by public auction of any personal property not needed for public use; now therefore
BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, that the Township shall conduct a public auction of the attached list of surplus township vehicles, in accordance with the provisions of N.J.S.A. 40A:11-36, on Wednesday, April 30, 2008 at 11:00 a.m.; and
BE IT FURTHER RESOLVED that this resolution shall replace and supersede the prior resolution authorizing the auction sale of surplus Township vehicles adopted by the Township Council on March 25, 2008.

On motion made by Mayor Remsen and duly seconded, the following resolution was adopted by unanimous vote:
WHEREAS, Renee Cohen, longtime Montclair resident, has served the community for many years through her involvement with the Montclair Ambulance Unit; and
WHEREAS, Ms. Cohen served first as an active ambulance volunteer beginning in 1978 and received her Life membership in December of 1988 which designation is made after an individual has been riding the ambulance for ten years. She continued to be an active rider until 1989; and
WHEREAS, Renee Cohen joined the Board of the Ambulance Unit in 1985 serving in a variety of positions including Treasurer, By-law Review Committee member, Head of the Budget committee, Head of the Nominating Committee, and as Fund Raising Chair; and
WHEREAS, Ms. Cohen is being honored for her years of service to the community after the April 23rd Ambulance Unit meeting which will be her last as an Ambulance Board member; now therefore
BE IT RESOLVED that the Council of the Township of Montclair, in the County of Essex, recognizes the many contributions Renee Cohen has made to our community and join with her family, friends, fellow Ambulance Unit volunteers and Montclair residents in recognizing her for her many years of service to the Township of Montclair.

On motion made by Mayor Remsen and duly seconded, the following resolution was adopted by unanimous vote:
WHEREAS, on February 14, 2008 the Township of Montclair opened and read bids for street improvements on Walnut Street and Roswell Terrace , as prescribed by law; and
WHEREAS, this contract has been awarded pursuant to a “fair and open process” as defined in the New Jersey Pay-to-Play law, N.J.S.A. 19:44A-20.4 et seq.; and
WHEREAS, Cifelli and Son Construction of 4 Coppola Street, Nutley, New Jersey submitted the lowest responsible bid, according to the specifications, in the amount of $192,942.80 ; and
WHEREAS, the monies for this project have been appropriated in the following Capital Budget Accounts:

BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, that CIFELLI AND SON CONSTRUCTION be and they are hereby awarded the above-stated contract, subject to the approval of Essex County under Title I of the Housing and Urban-Rural Recovery Act of 1983 (P.L. 98-181) and pending certification of funds by the Finance Director. Details of the contract are attached hereto and made a part hereof.

On motion made by Mayor Remsen and duly seconded, the following resolution was adopted by unanimous vote:
WHEREAS, on February 14, 2008 the Township of Montclair opened and read bids for street improvements on Montague Place, as prescribed by law; and

BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, that A & J CONTRACTORS be and they are hereby awarded the above-stated contract, subject to the approval of Essex County under Title I of the Housing and Urban-Rural Recovery Act of 1983 (P.L. 98-181) and pending certification of funds by the Finance Director. Details of the contract are attached hereto and made a part hereof.

LENAPE TRAIL SERVICES AGREEMENT:
Township Manager Joseph Hartnett reported on an earlier agreement which called for a $1,500 payment to the Township of Cedar Grove to provide refuse collection services to certain addresses on Lenape Trail. This agreement will be kept current. In addition, Montclair will continue to provide sewer services to other properties located on the street for a fee to be paid by property owners.

COTTAGE PLACE:
Mr. Hartnett stated that Township Attorney Alan Trembulak has prepared a license agreement (not an easement) with the Family Service League to allow for a “bump out” for handicapped parking which impinges on the public right-of-way.
