ORDINANCES – SECOND READING/ADOPTION
A. 2009 thru 2011 Salary Ordinance for American Federation of State, County, and Municipal Employees. Introduced and passed first reading February 2, 2010. Is there anyone present who wishes to be heard in relation to the proposed Ordinance? CLOSE HEARING. VOTE. (O_10_001) (Councilor Lewis, Deputy Mayor Terry) (In accord with the execution of the contract between the Township and AFSCME this ordinance provides for salary increases of 1% effective 1/1/09; 1.5% effective 1/1/10; 1.5% effective 7/1/10 and 3.25% effective 1/1/11)
B. 2010 thru 2012 Communication Workers of America Salary Ordinance. Introduced and passed first reading February 2, 2010. Is there anyone present who wishes to be heard in relation to the proposed Ordinance? CLOSE HEARING. VOTE. (O_10_002) (Councilor Lewis, Deputy Mayor Terry) (In accord with the execution of the contract between the Township and CWA this ordinance provides for salary increases of 1.0% effective 1/1/10; 1/5% effective 1/1/11; 1/5% effective 7/1/11 and 3.25% effective 1/1/12)
C. 2010 Non-Union salary ordinance. Introduced and passed first reading February 2, 2010. Is there anyone present who wishes to be heard in relation to the proposed Ordinance? CLOSE HEARING. VOTE. (O_10_003) (Councilor Lewis, Deputy Mayor Terry) (This ordinance provides for a 1.5% salary increase effective 1/1/10 and 1.5% effective 7/1/10 over 2009 salaries for all non-union management employees commensurate with Office and Professional Employees International Union 2010 increase)
D. Ordinance amending sections 107,109 and 110of Chapter 347 of the Township Code (“The Zoning Ordinance”) to establish amended signage regulations for Historic Districts. Introduced and passed first reading February 2, 2010. Is there anyone present who wishes to be heard in relation to the proposed Ordinance? CLOSE HEARING. VOTE (O_10_004) (This ordinance will prohibit neon signs in all commercial areas and will allow signs in historic districts to be placed outside the sign location band in recognition of the unique features of historic buildings)
E.Ordinance designating a downtown Business Improvement Zone in the Township of Montclair. Introduced and passed first reading February 2, 2010. Is there anyone present who wishes to be heard in relation to the proposed Ordinance? CLOSE HEARING. VOTE (O_10_005) (Councilor Lewis, Mayor Fried) (This ordinance will create a Downtown Business Improvement Zone with the same boundaries as the existing Montclair Center Business Improvement District to make the Township eligible to receive financial assistance for public improvement projects from the NJ Department of Community Affairs)
The below ordinances – F thru J - amend the Township’s Vehicles and Traffic Ordinance to prohibit, restrict, and provide parking on streets in the vicinity of Bradford School to address parking and traffic safety problems which have arisen as a result of an increase in demand for parking for both teachers and parents of the school.
F. Ordinance amending Section 327-16 of the Township Code (The “Vehicles and Traffic Ordinance”) to prohibit parking on a portion of College Avenue. G. Ordinance amending the supplementing Section 327-20 of the Township Code (The “Vehicles and Traffic Ordinance”) to provide for 30-minute restricted parking on Brainard Street, Amherst Place and portions of College Avenue, and 2-hour restricted parking on a portion of College Avenue. Introduced and passed first reading February 2, 2010. Is there anyone present who wishes to be heard in relation to the proposed Ordinance? CLOSE HEARING. H. Ordinance amending and supplementing Section 327-18 of the Township Code (The “Vehicles and Traffic Ordinance”) to prohibit parking during certain hours on portions of Valley Road and to provide for the issuance of special parking permits for Board of Education employees. Ordinance amending Section 327-18 of the Township Code (The “Vehicles and Traffic Ordinance”) to prohibit parking during certain hours on portions of Amherst Place, Brainard Street and College Avenue. K. An Ordinance to amend the 2009-2011 OPEIU salary ordinance. Introduced and passed first reading February 16. Is there anyone present who wishes to be heard in relation to the proposed Ordinance? VOTE (O_10_011) (Councilor Lewis, Deputy Mayor Terry) (This ordinance is being amended to add positions that were not formerly included in the Office and Professional Employees International Union)
L. Bond Ordinance providing for various capital improvements, appropriating the aggregate amount of $584,000 therefor and authorizing issuance of $554,800 bonds or notes of the Township to finance part of the cost thereof. Introduced and passed first reading February 16, 2010. Is there anyone present who wishes to be heard in relation to the proposed Ordinance? CLOSE HEARING. VOTE (O_10_012) (Councilor Murnick, Deputy Mayor Terry) (This ordinance appropriates $584,000 – including a CDB Grant in the amount of $250,000 – for improvements such as street, curb and sidewalk on George Street and Willard Place in the amount of $130,000, improvements and renovations to various parks and public property in the amount of $76,000, removal and replacement of trees in the amount of $162,000, acquisition of a snow plow/salt spreader for DCS in the amount of $216,000)
M. Bond Ordinance providing for traffic calming improvements, appropriating $1,186,000 therefor and authorizing the issuance of $1,126,700 bonds or notes of the Township to finance part of the cost thereof. Introduced and passed first reading February 16, 2010. Is there anyone present who wishes to be heard in relation to the proposed Ordinance? CLOSE HEARING. VOTE (O_10_013) (Councilor Murnick, Deputy Mayor Terry) (This ordinance will provide funding for Quiet Zone traffic calming)
N. Ordinance of the Township of Montclair, providing for the cancellation of $4,600,000 in bond authorization not needed for its original purpose (O_10_014) (Bond Ordinance #O-036-09 adopted July 21, 2009 provided funding for various improvements to sanitary and sewer collection system. These funds are no longer needed for this purpose.)
O. Ordinance authorizing the use of eminent domain to acquire properties commonly known as 59 and 61 Valley Road (block 2209 Lots 1 and 16 on the Montclair Township Tax Maps) (O_10_015) (The Township is exercising its right of eminent domain, in accordance with NJ statutes, to acquire property needed for public purposes. Property will be used for additional parking facilities for the Police Dept and Public Safety Building) (Deputy Mayor Terry)
Ordinances P, Q and R below are being introduced to increase available parking on Cooper Ave between Valley Rd and Northview Ave. These changes were originally proposed by the Traffic/Parking Ad Comm in ’09 and have been approved by the Engineering Dept. The street is wide enough -32 feet- to allow parking on both sides.)
P. Ordinance to amend the Traffic Ordinance to establish metered parking zones on a portion of Cooper Avenue (from a point 50 feet east of Valley Rd to a point 200 feet east therefrom)(O_10_016) (Councilor Lewis, Mayor Fried)
Q. Ordinance amending and supplementing Section 327-20 of the Township Code (The “Vehicles and Traffic Ordinance”) to provide for 2-hour restricted parking on a portion of Cooper Avenue) (O_10_017) (Councilor Lewis, Mayor Fried)
R. Ordinance amending Section 327-16 of the Township Code (The “Vehicles and Traffic Ordinance”) to prohibit parking on a portion of Cooper Avenue (O_10_018) (Councilor Lewis, Mayor Fried)
Ordinances S, T and U below are being introduced to reduce the queue of westbound vehicles at the intersection of Claremont Avenue and Grove Street. Police suggested to the Traffic/Parking Ad Comm. elimination of some parking on various parts of Claremont and Grove as a way to remedy this situation)
S.Ordinance amending Section 327-16 of the Township Code (The “Vehicles and Traffic Ordinance”) to establish revised parking regulations on portions of Claremont Avenue (O_10_019) (Councilor Baskerville, Councilor Lewis)
