PUBLIC COMMENT ON ORDINANCES ON FIRST READING, RESOLUTIONS AND PROCLAMATIONS

NEW BUSINESS
ORDINANCES – FIRST READING/INTRODUCTION

A. Ordinance amending the vehicles and traffic ordinance to prohibit parking on the easterly side of Grove Street from Oxford Street north to the Municipal boundary line (O-034-09)(This prohibits parking on the east side of Grove Street from Oxford Street north to the municipal boundary line) (Councilor Lewis)

B. Bond Ordinance providing for the replacement of the Glenfield No. 3 public supply well in and by the Township, appropriating $800,000 therefor and authorizing issuance of $800,000 in bonds or notes to finance part of the cost thereof (O-035-09) (This bond ordinance is for the replacement of the existing temporary airstripping facility at the Glenfield No. 3 Public Supply Well needed in order to comply with new groundwater rules. The project is eligible for enhanced NJEIT loans, approval of the ordinance allows for the application process to continue.)

C. Bond Ordinance providing for various improvements to the sanitary and sewer collection system in and by the Township, appropriating $4,600,000 and authorizing issuance of $4,600,000 bonds or notes to finance part of the cost thereof (O-036-09) (This bond ordinance is for system wide improvements to the Township’s sanitary sewer collection. The improvements include upgrading of existing piping, reduction of infiltration, manhole rehabilitation and other structural improvements. Approving the ordinance at this time will allow the Township to continue its quest to obtain partial Federal ARRA funding for the project.)

Consent Agenda
All items listed with an asterisk are considered to be routine by the Township Council and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember or citizen so request, in which event the item will be removed from the General Order of Business and considered in its normal sequence on the agenda. They will, however, be read by title and displayed in the Council chambers.

NEW BUSINESS

RESOLUTIONS

4. Resolution authorizing budget appropriation transfer (R-144-09) (This resolution and attachment is necessary as per State Statute in order for the Township to continue day to day operations through July 31st) (Councilor Africk/Councilor Murnick)

5. Resolution authorizing the Township of Montclair Tax Collector to prepare and mail estimated tax bills in accordance with P.L. 1994, C. 72 (R-145-09) (Councilor Baskerville) (This is standard operating procedure when budgets are late and the County Board of Taxation has not yet certified official tax rates. This resolution allows the Township to send out tax bills so that money can be received in a normal revenue cycle since these payments are due on August 1. Should these bills not be sent the Township would have to borrow money to meet its financial commitments) (Councilor Baskerville/Councilor Weller)

6. Resolution awarding contract for electrical services for the period from July 24, 2009 through July 23, 2010 with an annual option to renew for up to two (2) additional years (R-146-09) (Councilor Africk/Councilor Murnick)

7. Resolution authorizing amendment to the 2009 Temporary Capital Budget (R-147-09) (The Township needs to make temporary appropriations until such time as the State approves the final 2009 municipal budget)

8. Resolution authorizing the execution of a second amended and restated Intralocal Services Agreement with the Montclair Parking Authority to provide for the enforcement of parking ordinances and regulations by the Parking Authority (R-148-09) (This resolution is to enable the Parking Authority to take over enforcement responsibilities for parking violations, will enable the use of handheld computerized ticketing units, will enable the transfer of parking enforcement officers from the Police Department to the Montclair Parking Authority.(Councilor Lewis/Mayor Fried)

9 Resolution amending prior resolutions creating and redefining the Montclair Parking Advisory Committee (R-149-09) (This committee was created by resolution of 11-30-93 This resolution changes the composition of the committee and its defined role) (Councilor Lewis/Mayor Fried)

10. Resolution awarding a contract for management and operation of the Clary Anderson Arena (R-151-09) (This resolution authorizes that the stated contract pursuant to the RFP issued by the Township, providing for the operator to take over all operating costs including utilities and will offer a small commission schedule to the Township, and provide a six month termination clause) (Councilor Lewis)

11. Resolution authorizing the renewal of Alcoholic Beverage Consumption Licenses (R-152-09) (This represents the annual renewal process for alcoholic beverage consumption licenses within the Township) (Councilor Lewis)

12. Resolution authorizing the renewal of Alcoholic Beverage Distribution Licenses (R-153-09) (This represents the annual renewal process for alcoholic beverage distribution licenses within the Township)

The Council welcomes public comment at its meetings.
