Notice from Code Enforcement: Township to begin addressing complaints about broken and unsafe sidewalks

At the March 11 Council Meeting, the Mayor & Council voted to pass Ordinance O-25-05, which amends the Township code on Curbs, Sidewalks, and Driveways - specifically Section 1. Chapter 297-12.1: "Notice to repair sidewalks and curbs; costs" 

Prior to the ordinance passing, the language as-is in the sidewalk code was deemed unenforceable, thus keeping the township from addressing the current backlog of complaints about broken and unsafe sidewalks. The new ordinance authorizes the Division of Code Enforcement to determine when the condition of a sidewalk has become hazardous to public safety, and to subsequently issue notices to property owners. 
The township has received several complaints about sidewalks posing a threat to pedestrians and runners, sometimes forcing people to walk or run into the road, unnecessarily endangering residents or causing potential injury through trips and falls. By amending the code through the new ordinance, it's now possible for the Township to start addressing this issue with urgency. 
What does this mean for residents? 
  • If Code Enforcement determines a sidewalk is broken or in need of repair, the Township will issue the property owner a written notice, directing the sidewalk repair to be completed within 45 days. This has been increased from 30 days in the existing code. 
  • Code Enforcement will provide a packet along with the violation containing additional information such as permitting and construction specifications so that a homeowner may opt to do the work themselves.
